Terms & Conditions of Use

Please read these Terms & Conditions (“Terms”) carefully before using the FixNaija platform. By accessing or using FixNaija, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the platform immediately.

1. Introduction


FixNaija (“the Platform,” “we,” “us,” or “our”) is a civic accountability and budget transparency platform operated by FixNaija. The Platform enables citizens to post public infrastructure problems, track government responses, and monitor budget allocations across all 36 states and the Federal Capital Territory of Nigeria.

These Terms govern your access to and use of the FixNaija website, mobile applications, APIs, and all related services (collectively, the “Services”).

2. Eligibility & Account Registration


2.1 Age Requirement

You must be at least eighteen (18) years of age to create an account or use the Services. By registering, you represent and warrant that you meet this age requirement.

2.2 Account Accuracy

When creating an account, you agree to provide accurate, current, and complete information including your full name, email address, phone number, state, and Local Government Area (LGA). You are responsible for maintaining the accuracy of this information and for all activity that occurs under your account.

2.3 One Account Per Person

Each individual may maintain only one (1) active account. Creating multiple accounts to circumvent rate limits, bans, or moderation decisions is prohibited and may result in permanent suspension of all associated accounts.

2.4 Account Security

You are responsible for safeguarding your password and for any actions taken under your account. You must notify us immediately via the Contact Us form if you suspect unauthorised access to your account.

3. Anonymous Posting


FixNaija permits the submission of posts without creating an account (“Anonymous Posts”), subject to the following conditions:

  • Anonymous Posts receive lower priority in public feeds and may be subject to additional moderation review.
  • Anonymous users cannot edit or delete their submissions after submission. There is no account recovery mechanism for anonymous posts.
  • Anonymous users may not access community features such as upvoting, commenting, or petition signing.
  • All other provisions of these Terms apply equally to anonymous submissions.

4. Content You Submit


4.1 Ownership

You retain ownership of all content you submit to the Platform, including posts, photographs, videos, voice notes, and comments (“User Content”).

4.2 Licence Grant

By submitting User Content, you grant FixNaija a non-exclusive, royalty-free, worldwide, perpetual, irrevocable licence to use, display, reproduce, distribute, and create derivative works of your User Content for the purposes of:

  • Displaying the content on the Platform and in public feeds;
  • Sharing the content with government officials, journalists, researchers, non-governmental organisations, and civil society bodies for accountability, advocacy, and research purposes;
  • Generating data analyses, trend insights, and aggregated statistics;
  • Promoting the Platform through media coverage, press releases, and social media.

This licence survives the deletion of your account or content, to the extent that copies have already been distributed or incorporated into analyses.

4.3 Accuracy Warranty

You represent and warrant that all User Content you submit is truthful, accurate, and not misleading. You acknowledge that FixNaija is a platform for genuine civic accountability and that the submission of false, fabricated, or deliberately misleading posts undermines the integrity of the Platform and may result in account suspension or legal action.

4.4 Media Rights

By uploading photographs, videos, or voice recordings, you warrant that you have the legal right to capture and share such media. You agree not to upload media that infringes on any third party’s intellectual property, privacy, or publicity rights. Where media depicts identifiable individuals, you warrant that you have obtained their consent or that the media was captured in a public setting where no reasonable expectation of privacy exists.

5. Prohibited Conduct


You agree not to:

  1. Submit false, fabricated, or deliberately misleading posts for the purpose of defaming, harassing, or causing harm to any individual, organisation, or government body;
  2. Harass, threaten, or intimidate government officials, other users, or moderators through the Platform;
  3. Post content that constitutes hate speech, incitement to violence, ethnic or religious discrimination, or any form of speech prohibited under the laws of the Federal Republic of Nigeria;
  4. Impersonate another person, government official, or organisation;
  5. Upload malware, viruses, or any code designed to disrupt, damage, or limit the functionality of the Platform;
  6. Scrape, crawl, or harvest data from the Platform through automated means without prior written authorisation;
  7. Spam the Platform with duplicate, irrelevant, or promotional content;
  8. Attempt to circumvent rate limiting, account suspensions, moderation decisions, or any technical security measures implemented by the Platform;
  9. Use the Platform for any purpose that is unlawful under the laws of the Federal Republic of Nigeria or any applicable jurisdiction.

6. Geo-Location & Personal Data


6.1 Location Data

When you submit a post, the Platform may collect your GPS coordinates (with your device’s permission) to accurately identify the location of the posted infrastructure problem. This location data is used to assign posts to the correct jurisdiction (Federal, State, or LGA) and to display posts on the public map.

6.2 Data We Collect

In addition to information you provide at registration, the Platform may collect:

  • Device information (browser type, operating system, screen resolution);
  • IP address and approximate location derived from it;
  • Usage data (pages visited, features used, timestamps of activity);
  • Cookies and local storage data for session management.
6.3 Data Use

We use your data to operate the Platform, assign posts to the correct jurisdiction, generate anonymised analytics, enforce these Terms, and communicate important updates about your posts and account. We do not sell your personal data to third parties.

6.4 Data Retention & Deletion

Your personal data is retained for as long as your account is active. You may request deletion of your account and associated personal data by submitting a request via the Contact Us form. Upon deletion, your posts will remain on the Platform in anonymised form to preserve the public accountability record.

6.5 Data Protection

FixNaija is committed to protecting your personal data in accordance with applicable Nigerian data protection laws. Our full data protection compliance programme, including alignment with the Nigeria Data Protection Act (NDPA), is currently being implemented. A comprehensive Privacy Policy will be published separately and will be accessible from the Platform footer.

7. Government Official Accounts


Government officials (“Authority Users”) may register for dedicated accounts through the Authority Portal, subject to the following conditions:

  • Registration requires a valid .gov.ng email address and two-factor authentication (2FA);
  • All status updates, responses, and actions taken by Authority Users on the Platform are public and permanently recorded on the post timeline;
  • Authority Users may not delete or alter the public timeline of any post;
  • FixNaija reserves the right to revoke Authority User accounts for misuse, including marking posts as resolved without supporting evidence.

8. Moderation & Content Removal


FixNaija employs a combination of automated systems (including artificial intelligence) and human moderators to review content submitted to the Platform.

  • We reserve the right to remove, edit, or restrict any User Content that violates these Terms, without prior notice;
  • Accounts found to be in violation of these Terms may be temporarily suspended or permanently banned, depending on the severity and frequency of the violation;
  • Suspension tiers include: warning, 7-day suspension, 30-day suspension, and permanent ban;
  • You may appeal a moderation decision by submitting a request via the Contact Us form. Appeals will be reviewed within fourteen (14) business days.

9. Escalation & Public Advocacy


FixNaija operates an automated escalation engine designed to ensure that posted infrastructure problems receive timely attention. The escalation process operates as follows:

  1. 7 days after submission with no government response: a reminder is sent to the responsible Local Government authority;
  2. 30 days after submission with no resolution: the post is escalated to the State-level authority;
  3. 90 days after submission with no resolution: the post is escalated to Federal-level oversight and may be shared with media organisations and civil society groups for public advocacy.

By submitting a post, you consent to this escalation process, including the potential sharing of your post (and any associated evidence) with journalists, researchers, non-governmental organisations, and government oversight bodies. If you submitted anonymously, your identity will not be disclosed during escalation.

10. Intellectual Property


The Platform’s source code, user interface, design, logos, trademarks, and all non-user-generated content are the property of FixNaija or its licensors and are protected by applicable intellectual property laws.

The licence you grant to FixNaija over your User Content (as described in Section 4.2) is non-exclusive. You are free to share your own content elsewhere. However, you may not reproduce or redistribute other users’ content without their express permission.

11. Third-Party Services


The Platform relies on third-party services for infrastructure, data processing, and communication delivery. These include, but are not limited to:

  • Cloudflare — content delivery, DDoS protection, and SSL termination;
  • Google Cloud Platform — file storage (Google Cloud Storage) and compute infrastructure;
  • OpenStreetMap / Mapbox — mapping and geo-visualisation;
  • Africa’s Talking / Twilio — SMS and communication delivery (when activated);
  • Redis — caching and task queue infrastructure.

Your use of the Platform may be subject to the terms of service of these third-party providers. FixNaija is not responsible for the practices or policies of third-party services.

12. Disclaimer of Warranties


The Platform is provided on an “as is” and “as available” basis. FixNaija makes no representations or warranties of any kind, express or implied, regarding:

  • The accuracy or completeness of any User Content submitted by third parties;
  • The accuracy of budget data displayed on the Platform, which is sourced from official government documents and is presented as-is;
  • That any government authority will respond to, act on, or resolve any post submitted through the Platform;
  • That the Platform will be uninterrupted, error-free, or free of harmful components;
  • That any particular outcome will result from the submission of a post or the use of any feature.

13. Limitation of Liability


To the maximum extent permitted by the laws of the Federal Republic of Nigeria, FixNaija shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform;
  • Government inaction or failure to respond to posts submitted through the Platform;
  • The accuracy, reliability, or completeness of User Content or government budget data;
  • Loss of data resulting from technical failures, server outages, or force majeure events;
  • Any actions taken by third parties (including government officials) based on information published on the Platform.

In no event shall FixNaija’s total aggregate liability exceed the sum of Ten Thousand Naira (₦10,000).

14. Indemnification


You agree to indemnify, defend, and hold harmless FixNaija, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your use of the Platform;
  • User Content you submit, including any claims of defamation, intellectual property infringement, or invasion of privacy;
  • Your violation of these Terms;
  • Your violation of any applicable law or regulation of the Federal Republic of Nigeria.

15. Governing Law & General Provisions


15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

15.2 Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Federal Capital Territory, Abuja, Nigeria.

15.3 Changes to These Terms

FixNaija reserves the right to modify these Terms at any time. Material changes will be communicated through the Platform with at least thirty (30) days’ notice before taking effect. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

15.4 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.5 Entire Agreement

These Terms, together with any Privacy Policy or supplementary policies published on the Platform, constitute the entire agreement between you and FixNaija regarding your use of the Services.
